Service Agreement:
By engaging
AKEELA for onsite fuel delivery services, you enter into a service agreement, which outlines the scope of the services to be provided, pricing, delivery schedules, and any additional terms specific to your business requirements. The service agreement will be mutually agreed upon and signed by both parties before the commencement of services.
Fuel Delivery Requirements:
It is your responsibility to provide accurate and up-to-date information regarding the fuel type, quantity, delivery location, and any specific instructions necessary for a successful fuel delivery.
AKEELA will rely on the information provided by you and will not be liable for any issues arising due to incorrect or incomplete information.
Delivery Schedule and Access:
AKEELA will work with you to establish a mutually agreed-upon delivery schedule. It is your responsibility to ensure that there is safe and unobstructed access to the delivery location during the scheduled delivery time. Any changes to the delivery schedule or access arrangements should be communicated to
AKEELA in advance.
Fuel Quality and Compliance:
AKEELA is committed to delivering fuel that meets the necessary quality standards and regulatory requirements. We source fuel from reputable suppliers and adhere to industry best practices. However, the ultimate responsibility for verifying the quality, compatibility, and compliance of the fuel with your specific requirements rests with you.
Pricing and Payment:
The pricing for our onsite fuel delivery services will be agreed upon in the service agreement. All charges, including fuel costs, delivery fees, and any applicable taxes or surcharges, will be clearly stated in the agreement. Payment terms will be outlined, and you agree to make timely payments as per the agreed-upon terms.
Liability and Risk:
While
AKEELA takes utmost care in delivering fuel safely and efficiently, we cannot assume liability for any loss, damage, or accidents that may occur during or as a result of the fuel delivery. It is your responsibility to provide a safe and suitable environment for fueling operations. You agree to indemnify and hold
AKEELA harmless from any claims, damages, or losses arising from the use of our services.
Force Majeure:
AKEELA shall not be held liable for any delays or failures in the delivery of fuel caused by events beyond our reasonable control, including but not limited to natural disasters, adverse weather conditions, labor disputes, government regulations, or other unforeseen circumstances. In such cases,
AKEELA will make reasonable efforts to mitigate any resulting impact on service delivery.
Termination:
Either party may terminate the onsite fuel delivery services by providing written notice in accordance with the terms specified in the service agreement. Any outstanding payments or obligations shall be settled prior to the termination of services.
Confidentiality:
Any confidential information shared between you and
AKEELA during the course of providing onsite fuel delivery services shall be treated as confidential and used solely for the purposes of fulfilling the service agreement. Both parties agree to maintain the confidentiality and not disclose such information to third parties without prior written consent.
Governing Law and Jurisdiction:
These terms and conditions shall be governed by and interpreted in accordance with the laws of jurisdiction. Any disputes arising from or related to these terms and conditions or the onsite fuel delivery services shall be subject to the exclusive jurisdiction of the courts in jurisdiction.
